Lindsay Lohan Could Face Jail Time

This has been a tough year for troubled starlet Lindsay Lohan. Not only did her attempt to portray the late Elizabeth Taylor fail miserably on the small screen, but she faces more legal troubles.

Lohan’s lawyer predicts the actress will be exonerated after being arrested in a New York nightclub brawl. But new charges in California could result in jail time for the star.

Lohan was arrested on suspicion of third-degree assault, a misdemeanor, after she allegedly punched a woman in the face at Club Avenue in Manhattan’s fashionable meatpacking district.

Lohan also faces three misdemeanor charges for allegedly lying to Santa Monica police in connection with a June traffic accident on Pacific Coast Highway. Her lawyer in Los Angeles has not commented on that case.

If the prosecutor moves forward as expected, a judge could give her jail time after determining she violated her 2011 probation on a conviction for shoplifting from a Venice jewelry store. Santa Monica prosecutors weighed charges against Lohan for weeks after police said they found evidence that she lied when she told officers she was not behind the wheel of a Porsche that collided with a dump truck.

She was charged Thursday with obstructing an investigation, giving false information to an officer and reckless driving. Lohan has already been sent to jail several times for violating the terms of her probation, but she eventually complied with rules set down by Los Angeles County Superior Court Judge Stephanie Sautner.

More recently, the 26-year-old actress has been spending time in New York, where she has been part of several law enforcement investigations. In September, the actress claimed she was choked by a political aide in a New York hotel room. Charges against the man were dropped.

Lohan was then the subject of an investigation in which she was accused of clipping a man with her car outside another Manhattan nightclub. No charges were filed in that case.

In October, police were called to a reported domestic disturbance at Lohan’s mother’s home in Mineola, N.Y., after what was described as an argument between the actress and her mother. The incident did not result in any arrests or charges.

Thursday’s incident occurred inside Club Avenue. Police said Lohan was sitting inside a black SUV when officers arrived and arrested her at about 4 a.m.

Lohan was not injured and the alleged victim, whose injuries were not disclosed, refused medical treatment at the scene, officials said.

Linday Lohan Lied To Santa Monica Police

Troubled starlet Lindsay Lohan is not known for her honesty, but she is known as a menace to society. She has already been in several car accidents. In one of those car accidents, she was less than truthful.

The Santa Monica Police Department says it has evidence that Lohan lied when she claimed she was not behind the wheel of a Porsche that collided with a dump truck earlier this year, and prosecutors are weighing whether to file charges, which could land her back in jail, it was reported today.

New charges could be considered a violation of her 2011 parole for shoplifting and lead to her returning to L.A. County jail.

An investigation has determined that Lohan was driving the Porsche during the June collision. The finding contradicts statements Lohan made after the crash to law enforcement officers.

The Los Angeles County district attorney has already determined the matter is not worthy of a felony filing and referred the matter to the Santa Monica prosecutor’s office to determine if the false statement amounts to a violation of the law. The office is expected to take action this week on the case.

Lohan was given probation for a 2007 conviction for driving under the influence. She was later convicted of shoplifting from a Venice jeweler.

The actress was sent to jail several times for violating the terms of her probation. But she eventually complied with a schedule of community service at the county morgue and counseling.

Celebrities Gone Wild Behind The Wheel

What do Halle Berry, Britney Spears, Lindsay Lohan and Amanda Bynes all have in common? Aside from being internationally known superstars, they have all been involved in hit-and-run incidents.

Celebrities are brilliant at some things – like driving under the influence of alcohol or drugs – but their driving skills leave a little to be desired.

Amanda Bynes might be the latest lady to hit the headlines on account of her negligent driving, but she’s got a long, proud tradition of celebrities who can’t drive behind her. So who else has been unlucky when they’ve rolled the furry dice?

If anyone has seen and done it all by now, it’s Britney Spears. In 2007, Spears was charged with a misdemeanor count of hit and run, according to People magazine. She hit a parked car then left the scene, making no attempt to contact the driver – not even a nice note. She might have got away with it, if the incident wasn’t captured on camera by a celebrity reporter. Britney wasn’t charged, put paid the car’s owner around $1,000 in damages.

Car trouble sometimes befalls the most prestigious actors. In February 2000, Oscar winner Halle Berry drove through a red light – and got charged with a misdemeanor hit and run. Berry crashed into another woman’s car, but didn’t stick around. However, according to People magazine, she reported the accident to the police when she arrived at the hospital. She is believed to have received 22 stitches for a deep cut on her forehead, and was sentenced to 250 hours community service and a three year probationary period. She settled out of court with the driver.

Of course, the queen of car crashes – literal and figurative – is Lindsay Lohan. The star has been in trouble for DUI offences and partying on numerous occasions, and on Wednesday she hit a pedestrian in her car in Manhattan. Insiders believe that she had been drinking, but these reports are unconfirmed.

If you or a loved one were the victim of a car accident that was caused by negligence or some other form of reckless behavior, it is important that you contact a committed and dedicated personal injury lawyer to help you decide if you should file a lawsuit. Lindsay Lohan Tries To One Up Amanda Bynes

Amanda Bynes’ troubles with the law were so last week. This week Lindsay Lohan tried to best the other actress by behaving badly.

A Manhattan chef who was hit by Lohan claims the Porsche-driving starlet was “slurring” her words and “smelled like alcohol.”

The troubled “Mean Girls” actress was charged with leaving the scene of an accident two hours after the 12:30 a.m. incident in an alley between the Maritime and Dream hotels in Chelsea. She was given a desk appearance ticket and released.

Police Commissioner Raymond Kelly said police don’t think Lohan — a rehab regular who is on probation — was intoxicated, but no Breathalyzer test was performed.

Lohan’s father, Michael, who’s had his own legal problems, defended her.

The driveway where the accident happened serves as the entrance to the Electric Room, an exclusive club inside Dream.

Rodriguez said he had just left Bottega, the restaurant where he works at the adjacent Maritime, and was walking on the underground ramp when he “saw this car come real quick and hit me.”

He said when Lohan emerged from the Porsche Cayenne, “I asked, ‘Why did you do that?’

Rodriguez said one of the men in the car moved Lohan from the driver’s seat into the back and then told him there was “no problem.”

Rodriguez said he didn’t recognize Lohan.

He called 911 and was taken to Bellevue Hospital, where he said doctors told him he has torn tendons and gave him morphine for the pain.

It’s unclear where Lohan went.

Kelly said she left the scene and cops arrested her when she returned about 2:30 a.m. A rep for the Electric Room said the notorious party girl was not there Wednesday.

In addition to filing a complaint with the police, Rodriguez made an incident report with the Maritime’s garage in which he said “the female appeared disoriented.”

“Mr. Rodriguez took pictures with his cell phone of the vehicle license plate but was prevented from taking pictures of the individuals by Dream Hotel security,” the report says.

Lohan gave police a California address, and the Porsche has Florida plates, but she’s reportedly looking for a pad in Manhattan with her assistant, Gavin Doyle.

But experts say the latest run-in could cause major legal problems for Lohan — who has two DUI convictions on her record and is on probation in connection with a necklace theft.

He said a jail sentence wouldn’t be the typical outcome, but noted that Lindsay’s many scrapes with the law may have exhausted her judge’s patience.

Lindsay Lohan Is Jealous Of Amanda Bynes

Troubled starlet Lindsay Lohan doesn’t understand why cops are giving Amanda Bynes a break. Maybe it’s because Bynes doesn’t quite have a long enough rap sheet.

Lindsay Lohan, who knows her away around the criminal justice system, thinks the cops and prosecutors are going easy on actress Amanda Bynes.

Bynes, the Nickelodeon TV child star turned “Easy A ” actress, was pulled over Sunday by Burbank airport police while driving her BMW. The officer cited Bynes, towed her car and let her go.

At the time of the incident, Bynes was already facing two hit-and-run charges and one of driving under the influence. Her driver’s license was revoked August 25 after the hit-and-run charges.

The fact that Bynes was let go Sunday seemed to irk Lohan, who was arrested and hauled off to jail several times while on supervised probation for five years for a DUI and a subsequent charge of shoplifting jewelry.

“Why did I get put in jail and a nickelodeon star has had NO punishment(s) so far?” Lohan wrote on Twitter.

The tweet was quickly endorsed by some of her 4-million-plus followers on the social network.

Bynes, 25, is facing a drunk-driving charge after hitting a Los Angeles County sheriff’s cruiser April 6 in West Hollywood. After two more charges of hit and run were filed earlier this month, Bynes’ driver’s license was suspended, officials with the state Department of Motor Vehicles said. The charges are in connection with incidents April 10 and Aug. 4.

Lohan’s criticism may be motivated in part by the news that Bynes was pulled over Sept. 9 because her lights were not on. In that incident, Los Angeles police officers never asked for her driver’s license, which had been suspended Aug 25. Driving with a suspended license is against the law.

Then Sunday about 8:20 a.m., airport police pulled Bynes over. But instead of arresting her and taking her into custody, police cited and released her.

“These are the moments that I appreciate, my life experiences, living without regrets and Disney for supporting me as an actress — night all,” Lohan posted on Twitter shortly after her Bynes comment.

Lohan’s career is rebounding after an  L.A. County Superior Court judge ended her supervised probation in March and praised her for completing her community service and ending five years of criminal court appearances that saw her jailed several times.

During Lohan’s lengthy probation stemming from two DUI arrests, she has been repeatedly jailed by judges for various violations, including using drugs and alcohol and failing to perform her required community service at a downtown women’s center.

Judge Stephanie Sautner sentenced Lohan to jail and saw her placed under house arrest for her probation violations. Sautner then imposed a strict set of monthly community service and therapy requirements with a warning that the actress would be jailed if she did anything wrong.

Lohan has publicly credited the judge and Lohan’s attorney, Shawn Holley, with helping her rebuild her life and career, which hit rock bottom with the necklace theft conviction.

She recently completed a movie for Lifetime, in which she plays actress Elizabeth Taylor.

Lindsay Lohan Is Also A Thief

Not only does Lindsay Lohan have a drug problem. Apparently, she also likes to steal from people’s homes. We sincerely hope that the troubled starlet doesn’t run into LL Cool J anytime soon.

Although Lohan is off the hook concerning a theft from a Hollywood Hills home, she seemed still upset about the situation four days after the alleged incident, according to her Twitter comments.

The actress went to Twitter to decry “lies” being told about her regarding the theft.

“Whenever I’m doing great, people fabricate lies.” Lohan wrote. “It’s such a shame.”

Los Angeles Police Department detectives had presented evidence to prosecutors Tuesday after several days of investigation, identifying Lohan as well as Gavin Lawrence Doyle and Andrew Nicholas Payan as suspects in the case.

Lohan and one of the alleged victims, identified as millionaire Sam Magid, had a “long-standing relationship,” and he did not identify any of the suspects, prosecutors said.

Although one of the suspects made a “vague admission” that someone had taken something, none of the suspects was found with any property.

In addition, prosecutors noted in the filing that eyewitnesses in the case did not cooperate with authorities, and the victims did not wish to pursue a criminal prosecution of the case.

LAPD detectives had been seeking to talk with Lohan after several items, including cash, sunglasses and a credit card holder, were reported stolen from a home Aug. 18.

The incident is the latest in a series of brushes with the law for Lohan, who has been trying to put her much-chronicled legal troubles behind her and resume her acting career.

She was on probation for a 2007 conviction for driving under the influence. Since then, she has also been convicted of shoplifting and was on probation for that offense as well.

Lohan was sent to jail several times for violating the terms of her probation. But she hewed to a strict regimen of counseling and community service at the county morgue.

In March, a judge ended her probation in the DUI case and reduced the shoplifting probation to unsupervised status.

In the latest case, according to prosecutors, the victims were asleep in the residence about 7:45 a.m. Aug. 18, when they became aware that someone was trying to get into the master bedroom of the home.

They searched for the suspects and saw a man later identified as Doyle standing outside the home. The man fled. While trying to call 911, an unidentified woman at the home saw a newer model BMW parked in front of the home and a second man enter the vehicle, which then drove away.

When LAPD officers arrived at the home, the victims reported that keys from cars at the home as well as cash, sunglasses and a credit card holder were missing.

Day laborers working across the street identified two men and a woman who arrived at the residence in a tan BMW around the time the crime reportedly occurred and then went inside.

But police were unable to find any evidence of forced entry into the cars or the home. A security guard interviewed by police said that at 2 a.m. that morning Lohan came to the home and wanted to enter it to speak with Magid.

She was told she could not come in and asked the guard if Magid was in the home with “some other girl.”

Judges In Lindsay Lohan’s DUI Case Are Disciplined

Judges involved in high-profile celebrity court cases need to be fair and balanced in all their legal proceedings. The failure to uphold proper legal procedures may result in intense scrutiny and the appearance of favoritism, especially in cases involving troubled actress Lindsay Lohan.

Two veteran Los Angeles County judges were disciplined by a state oversight panel for their handling of the high-profile DUI case of actress Lohan.

The documents revealed that L.A. County Superior Court judges Marsha Revel and Elden Fox at the Beverly Hills courthouse were reproached by the state’s Commission on Judicial Performance for two incidents that occurred during a period of intense media attention in 2010, culminating in the star’s two-week term behind bars.

The commission acted on accusations that Revel improperly met alone with an attorney who wanted to take over Lohan’s defense, and that Fox erred in denying the actress bail on a relatively minor charge and refusing to hear her attorney’s arguments.

The commission’s involvement in Lohan’s case was spurred, at least in part, by a complaint filed in January 2011 by former Los Angeles County court spokesman Allan Parachini soon after he was fired for allegedly leaking information to the media. Parachini denied the leak and accused the court of discriminating against him because he suffers from severe depression.

In his letter to the commission, Parachini said he witnessed impropriety by Revel and Fox that he said was “due, in part, to the reality that many judges get caught up in celebrity litigation and part company with their experience and common sense.” The commission responded in a letter dated December 19 that the agency had “taken an appropriate corrective action as to each judge named” in Parachini’s complaint.

The commission, which investigates claims of judicial misconduct, issues discipline only in rare cases. Of 1,138 complaints it received in 2011, 42 resulted in discipline. All but six judges were disciplined in private.

The agency’s annual report includes summaries of private discipline cases without naming the judges or parties involved. Two case descriptions included in the 2011 report closely mirrored Revel and Fox’s handling of Lohan’s case, suggesting that the judges received “advisory letters,” the lowest level of discipline.

One judicial expert compared the commission’s action to a “wrist-slap” but said the judges’ conduct involved “fairly basic” legal mistakes.

Revel did not respond to requests for comment. Fox declined to comment, saying he would not confirm that he had been disciplined, but added: “You can read about it in the commission’s report.”

Lindsay Lohan Doing Fine Following Car Accident

Troubled starlet Lindsay Lohan was involved in a car accident on her way to a movie set Friday morning.

The 25-year-old actress, who looks like she’s pushing 40, was driving in a rented Porsche Panamer along the Pacific Coast Highway in Santa Monica when she collided with a big rig. She was headed to the set of “Liz & Dick” before she rear-ended the 18-wheeler.  Lohan’s assistant was riding in the passenger seat and was slightly injured in the car wreck. Lohan, her assistant and the driver of the other vehicle were taken to the hospital and treated for minor injuries.

The black Porsche Lohan was driving sustained the most damage on the passenger side. The window on the right side was shattered.

According to TMZ, which first broke news of the accident, Lohan claims that she’d been cut off by the truck driver. Now she claims that her brakes failed and that’s why she couldn’t stop in a timely manner when the other driver cut her off.

The truck driver on the receiving end of Lohan’s Porsche has hired a lawyer to represent him because he claims he was injured in the crash. He wants compensation for his pain and suffering.

The other driver said he went to see a doctor on Sunday, despite telling everyone that he was OK. On the advice of his lawyer, he did not discuss the nature of his injuries.

As if that wasn’t bad enough, the truck driver also claims that Lohan’s representatives tried to bribe him, but he declined.

Surprisingly, Lohan, who has had her fair share of troubles in recent years, was not under the influence of drugs or alcohol. Lohan did not show any signs of intoxication and she was not cited for anything.

In 2006, Lohan was arrested twice for driving under the influence. Lohan continues to deal with a litany of legal troubles.

In the last several weeks, Lohan has been filming an Elizabeth Taylor biopic for Lifetime. Amid much criticism, Lohan was cast to play the role of the late iconic actress.

Like many celebrities with substance abuse problems, Lohan is an accident waiting to happen. Sadly, every time she gets behind the wheel, something terrible happens.  The same could be said about regular people with substance abuse problems.

If you or someone you know has been injured in a car accident and you suspect alcohol or drug abuse, you should seek the legal advice of a personal injury attorney. Only a trained injury lawyer can help you receive the compensation you deserve for your pain and suffering.
